Can people understand your terms and conditions?
This is a longish article but if customer relationships are important to you than it is definitely worth studying.
I recently purchased some goods from this company. And I was fascinated to read their terms and conditions.
Most companies try to hide their terms and conditions. In fact, they are regularly referred to as the small print. And, as we know, small print is very difficult to read. Not only do they make it difficult to read but they also make it difficult to understand. The wording is so often full of legal jargon that you would have to be a barrister to understand it.
Just take a look at these terms and conditions from J & K Marketing Ltd. I think that you will be impressed by the use of easy to understand language and meaningful examples.
Then try taking a look at your own terms and conditions. How do they compare?
- J & K Marketing Ltd are a UK authorised dealer or distributor for all of the products featured on the adventure-motorcycling.co.uk website. Our company contact details can be found on the website under the "Support" menu.
- All goods and services are as described on the adventure-motorcycling.co.uk website and are supplied new with manufacturer's warranty.
- The purchase price figure includes all taxes including UK VAT.
- We aim to deliver good to you within 10 working days.
- After you have placed your order, for whatever reason we are unable to meet our delivery service level we will contact you as soon as we become aware of the delay, normally within 24 hours of taking your order. You will be advised of the expected delay time then may choose to receive a refund or continue with your order.
- Where possible customer should use our on-line Tracking Service to check the delivery status of their order.
- All orders over £100 include UK Mainland insured postage and packing with 48-hour delivery service. At extra cost customers may upgrade their UK mainland delivery service to next day or rest of UK 48 hour service. Orders under £100 will be charged postage.
- Goods must be paid for on-line by credit card or by contacting us via E-mail to prearrange cheque payment.
- We are sorry but our products and services cannot be supplied to Northern Ireland.
- Under the terms of the Consumer Protection (Distance Selling) Regulations 2000, you are entitled to a cooling off period of 7 working days after the goods or services are delivered to you. If we receive the goods in a condition that can be sold again as new with all of the packaging undamaged, software seals unbroken, you will be entitled to a full and prompt refund, less the return postage charges. If goods or services are returned in any other condition we reserve the right to refund the second hand value of the items damaged. For example you have purchased an Adventure Motorcycling GPS Package but have damaged or lost the packaging to a pack of rechargeable batteries. If all other items are returned in otherwise perfect condition you would be entitled to either keep the batteries or return them in second hand condition. If you decided to keep the batteries, we would refund you for the GPS package less the replacement value of the batteries and the cost of return post and packing. If the batteries were returned to us without or with damaged packaging we would refund you for the GPS package less the second hand value of the batteries. Because of the stringent copyright and software licensing regulations we would stress the importance of not opening MapSource software unless you are absolutely sure you want to keep the goods purchased. It is possible to inspect the features of our GPS products using a demonstration mode without the need to open the Software and Download the street-level map software to your GPS. In order to exercise your right to return goods to us under the terms of the Consumer Protection (Distance Selling) Regulations 2000 we must have received a notification E-mail in the returns@adventure-motorcycling.co.uk mailbox by 9 am on the 8th working day after the couriers signed delivery date. Please also read note 11,12 and 14.
- If during the first 30 days from the date of sale undamaged purchases prove faulty during normal operation you will be entitled to a full refund or a replacement. If the goods are misused or damaged by you, you will waiver your right to a full refund. There is no postal charge for the return of qualifying goods under this section. Please also read notes 10,12 and 14.
- After the initial 30 days all faulty goods should be returned to the manufacturer and a repair or replacement should be sought under the terms of the manufacturers warranty. Please also read notes 10,11 and 14.

- RETURNS - Whilst we hope that you will be delighted will all of the goods and services you receive from
adventure-motorcycling.co.uk there may be times when you will need to return good to us.
TO ENSURE YOU RECEIVE A PROMPT REFUND AND TO AVOID POSSIBLE PERSONAL LOSS IT IS IMPORTANT TO FOLLOW THE FOLLOWING EASY STEPS. Please also read notes 10, 11 and 12.
- Complete the Returns Form on your Website under the "Support" menu
- On receipt of your details we will make contact with you.
- If required, we will send you appropriate packing material, although we reserve the right to deduct the "cost price" of the packing material and postage from your refund. We will advise you if there is any charge at the time you request the packaging materials.
- We will then make arrangement for the items to be collected from your address.
- Our terms do not affect your statutory rights under consumer law.
